Court Stops 50% ECD Teachers Salary Cut

The Employment and Labour Relations Court in Kenya has issued an interim order halting the Salaries and Remuneration Commission’s plan to reduce the salaries of over 45,000 Early Childhood Development Education (ECDE) teachers by 50%.

The circular sent on 13th January, 2023, claimed that some counties were paying ECDE teachers above their pay grade, and recommended a review of salaries.

Kenya Post Primary Education Teachers (KUPPET) chair Omboko Milemba filed a case against the commission, stating that the circular would mean that nursery school teachers would earn half their salary, with some earning less than house helpers, who have a minimum wage of Sh 13,572.

Justice Ann Mwaure ruled in Milemba’s favor, ordering the government to retain current salaries until the case is heard and determined.

Milemba argued that the unilateral variation or reduction of salaries would demotivate performing teachers and lead to a deterioration of standards and quality of education in the early childhood education level in the country.

The court heard that there are 43,874 ECDE teachers employed by 47 county governments, of whom only 14,919 are permanent and pensionable, while the majority are on three-year contracts.

An ECDE teacher currently earns a minimum of Sh 15,000 per month, and the circular would have reduced this to Sh 7,835 for some. Those with senior roles and over 12 years of experience would have earned between Sh 15,224 and Sh 19,090 per month.

Milemba also argued that the commission never consulted stakeholders nor conducted public participation. He said that nursery school teachers would suffer and that this would be a mockery to men and women entrusted to nurture children from their initial years at school.

Some counties have already implemented the circular, Milemba told the court. The case highlights the importance of fair wages and consultations in employment decisions, especially in the education sector, where teachers play a crucial role in shaping the future of children.

The court’s interim order ensures that the affected teachers will continue to earn their current salaries until the case is heard and determined.
