On Tuesday, twenty-four students from Kanjuri and Kiarithaini High Schools in Mathira, Nyeri County, were charged with malicious property damage, preparing to commit a felony, and possessing bhang.

This comes after Karatina Principal Magistrate Karen Njalale denied the State counsel’s request to have the charges against the students postponed for two weeks to allow the prosecution to review the files and make a decision.

On October 28, students from Kanjuri High School, the majority of whom were underage, were charged with destroying a transformer worth Ksh. 1.1 million at the school.

Others were charged with possessing gasoline and a matchbox, while two were charged with possessing a roll of bhang.

Five Kiarithanini High School students were charged with possessing two jerricans of petrol with the intent to commit arson.

All of the students who pleaded not guilty were released on bond, with their parents and guardians instructed to deposit a copy of their ID cards and cell phone numbers in December, when the cases will be heard.

Earlier, state counsel Mary Kangethe asked the court to postpone charging the students for two weeks and release them to their parents after the regional director of public prosecutions recalled the files.

However, in her decision, the court denied the application, stating that, given the escalation of student unrest in the country, it is time for decisive action to put an end to it.

“As a court it’s the time for decisive and firm action… These are students who should be in school and not in the corridors of justice,” said Njalale.
